How will it affect a pending or previously-approved project?
See Section 1.7.4 of the new zoning ordinance to understand how the adoption of the new zoning ordinance will affect projects (site plans, plats, planned unit developments/concept plans, etc) approved prior to the effective date, or pending when the effective date occurs.
Ordinance for 2006-75: (NOTICE: Adopted 10/9/07, amended 6/10/08 related to process and procedures, and Effective Date 7/1/08*):
The following constitutes the version of Ordinance 2006-75 approved by BOMA on 10/9/07, revised 6/10/08, and to be effective 7/1/08*.
*IMPORTANT DEVELOPMENT: At its meeting of 12/18/07, BOMA passed an ordinance (Ord 2007-115) to delay the effective date of the new zoning ordinance from 1/1/08 to 7/1/08.The effective date was deferred to 7/1/08 for two primary reasons:
- To better inform the newly elected aldermen and other interested stakeholders of the differences between the current and new zoning ordinance (see schedule of workshops below), and
- To study the processes in the new ordinance to see if there is room for improvement. This effort to study the processes culminated in the adopted of Ordinance 2008-14. The 7/1/08 effective version of the zoning ordinance reflects these revised processes.
Side-by-Side Comparison Workshops:
A series of workshops were held to inform the newly elected aldermen, the planning commissioners, staff, developers, designers, property owners, and other interested parties of the differences between the current and new zoning ordinance. Ordinance Adoption Timeline:
- 2002 to 2004: Franklin Land Use Plan developed and adopted.
- December 2004 to February 2005: The Zoning Ordinance Advisory Committee (ZOAC), which consisted of the entire Planning Commission (FMPC), Board of Mayor and Aldermen (BOMA), and appointed citizens, developed the ordinance new zoning ordinance text to implement the 2004 Land Use Plan.
- September 7, 2006 to December 14, 2006: FMPC review and recommendation to BOMA.
- September 4, 2007: Special BOMA for Zoning Ord (Public Hearing) (Approved on 1st reading, with the revisions in Attachment G and D)
- September 25, 2007: BOMA Regular Meeting (Second Public Hearing Held) (Approved on 2nd Reading, with two revisions:
- Attachment A and B (9/25/07 versions) are cited in the cover ordinance as the most recent versions of the ordinance and maps, and
- Amended Section 5.10.8, (2) (vii) on page 5-172 to read: (vii) Garbage cans shall be placed on 2-foot by 2-foot concrete pads located on each lot.
- September 27, 2007: Ordinance 2006-75 sent back to FMPC to get a recommendation on any substantive amendments. The FMPC recommended approval of the revisions to Ordinance 2006-75 to BOMA, and recommended that BOMA reintroduce the accessory dwelling concept into the ordinance.
- October 9, 2007: BOMA Regular Meeting (Ordinance approved on 3rd and Final Reading)
- December 18, 2007: BOMA passed an ordinance (Ord 2007-115) to delay the effective date of the new zoning ordinance from 1/1/08 to 7/1/08.
- June 10, 2008: approves changes to the new zoning ordinance text related to processes and procedures (Ordinance 2008-14).
- July 1, 2008: Effective Date
