In June 2006, the Transfer of Development Rights (TDR) Task Force was appointed by Mayor Tom Miller to investigate and develop a TDR program for Franklin. It included City Aldermen, County Commissioners, Planning Commissioners, developers, non-profit and interested citizens. More than 30 meetings were conducted over a period of almost one year. The Task Force developed policies and recommendations for Franklin described in their report. The Task Force concluded its efforts in April 2007 and sent their recommendations to BOMA in May.

 

Mission Statement:

The purpose of the transfer of development rights (TDR) program is to provide a voluntary, incentive-based process that balances the rights of the landowners with the initiative to permanently preserve community-valued resources. The TDR program will be implemented by:

  1. Preserving the city’s unique character and resources;
  2. Conserving amenities of open space;
  3. Coordinating sound development;
  4. Promoting efficient use of land and public services; and
  5. Providing an effective and predictable incentive process for individual landowners and developers.

Status of TDR (updated 9/12/07)

  • TDR Task Force Work Concluded: On April 19, 2007, the TDR Task Force conducted its final meeting to review the findings of the three subcommittees. Additional recommendations and refinements were discussed at that meeting, and a motion passed to adopt the report and send it to the Board of Mayor and Aldermen (BOMA) for consideration at its May 2007 regular meeting.


  • BOMA Work Session: At the May 8, 2007, BOMA meeting they received the TDR Task Force report (see link above) and asked that it be placed on a BOMA Work Session Agenda for more discussion and a more in-depth presentation on the concept. The BOMA Work Session is scheduled for was held May 22, 2007, at 6:00 pm in City Hall.

BOMA Work Session: A BOMA Work Session is scheduled for September 25, 2007, at 6:00 pm in City Hall for Rick Pruetz, an urban planner who runs a consulting practice specializing in TDR workshops, studies and ordinances, to give a critique of the May 2007 TDR Task Force report.

  • Saved By Development: Preserving Environmental Areas, Farmland and Historic Landmarks With Transfer of Development Rights by Rick Pruetz:Franklin Tomorrow and the City of Franklin are pleased to announce an upcoming public lecture: Tuesday, Sept. 25th, 2007 at 4:00 p.m. at Franklin City Hall (109 3rd Ave. South). Rick Pruetz, American Institute of Certified Planners, holds a Master of Urban Planning degree from the University of Wisconsin-Milwaukee. He has been a planner for 24 years and runs a consulting practice specializing in TDR workshops, studies and ordinances.  Transfer of development rights, or TDR, can be thought of as a way of encouraging the reduction or elimination of development in areas that a community wants to save and the increase of development in areas that a community wants to grow. In 1999, Rick Pruetz began a consulting practice specializing in transfer of development rights and related planning/preservation tools. To date, he has prepared TDR studies and/or ordinances for more than 20 communities including Davis County, Utah, Santa Fe County, New Mexico and Livermore, California. Prior to 1999, he served as the City Planner of Burbank, California for over 14 years and worked as a planner for Waukesha, Wisconsin and Camp Dresser McKee. In addition to the preparation of TDR studies and ordinances, Pruetz has conducted numerous workshops and presentations on TDR throughout the U.S. He has written several articles about TDR as well as two TDR books including Saved By Development and Beyond Takings and Givings.   • FMPC Workshop: The Franklin Municipal Planning Commission will hold a training session on September 27, 2007, from 5:00 pm to 7:00 pm at City Hall to further explore the TDR concept and the May 2007 TDR Task Force report.
