Annexation


What is annexation?

Annexation is the process by which the city extends its municipal services, laws, taxing authority, and voting privileges to a new territory.  Annexation encourages orderly growth and provides standardized service to all citizens. It also promotes fairness by requiring that those who use the services provided by a city share in the costs of operating the city.

 

What documents are involved in an annexation?
There are three parts to an annexation:

  • RESOLUTION TO ADOPT PLAN OF SERVICE (POS): The POS describes how the City will service the properties upon annexation into the city.  Services include police protection, fire protection, refuse collection, streets and signage, traffic control, water and wastewater, building and code inspection services and recreation services. The POS takes the form of a resolution.
  • ORDINANCE TO ANNEX: The annexation ordinance is a legal document that describes properties proposed for annexation.  A map of the area accompanies it.
  • ORDINANCE TO ZONE: Since the properties are located in the county with county zoning, the zoning ordinance assigns a city zoning district to the properties upon annexation.

Why is annexation proposed?
As areas adjacent to the City of Franklin develop, conditions emerge that can be addressed more effectively by a broader range and higher level of services provided by the City, such as police and fire protection and solid waste collection.

 

The City studied areas in a pattern as a whole, where services extensions are possible, and where development activity is or may be occurring.  These areas proposed for annexation were part of the 2006 Annexation Feasibility Study, which can be found here.  These ordinances are recommendations to the Planning Commission and the Board of Mayor and Aldermen. 

 

What is the role of the Planning Commission in annexation? 
The Planning Commission recommends either approval or disapproval of each of the three parts above to the Board of Mayor and Aldermen.

 

What happens after the Planning Commission meeting? 
The Board of Mayor and Aldermen will (BOMA) receive the Planning Commission recommendation and will hold three readings with a public hearing, usually at the second reading.  The public can address BOMA during the public hearing.

What is a rezoning or PUD?

When the zoning map currently does not support the applicant’s intended use of the property, a request is made to amend the map to change a subject property to a zoning district classification that will permit the proposed land use(s). Franklin has two types of rezonings, conventional and planned unit developments (PUDs).

  • Conventional Rezoning: A conventional development is one that is designed to meet the minimum standards of the zoning ordinance. Assuming that the property is zoned appropriately for the type of development proposed, an applicant may submit preliminary and/or final plats. A Planned Unit Development (PUD) is not considered a conventional development.
  • Planned Unit Development (PUD) Rezoning: To achieve a superior design, which may not be permitted by the conventional zoning regulations, the applicant may request that a development by considered as a PUD. Although the standard regulations may become more flexible in a PUD, the applicant has to provide extremely detailed plans for the development, which become a “mini zoning ordinance” for that project. A PUD involves the rezoning of land to a planned district.

 

What is the role of the Planning Commission in zoning or a PUD?

The Planning Commission recommends either approval or disapproval to the Board of Mayor and Aldermen of the Ordinance to rezone a property. With PUD rezonings, conditions are often attached to the final approval by Board of Mayor and Aldermen to achieve a superior design or for the phasing of infrastructure.

 

What happens after the Planning Commission meeting? 
The Board of Mayor and Aldermen will (BOMA) receive the Planning Commission recommendation and will hold three readings with a public hearing, usually at the second reading.  The public can address BOMA during the public hearing. If the rezoning or PUD is approved, subsequent plans such as final subdivision plats or site plans for the property are then heard only by the Planning Commission, and do not require BOMA action.
